Privacy Policy

LAST UPDATED: March 31, 2020

PDF Solutions, Inc. (“PDF,” “we,” “us“) wants you to be familiar with how we collect, use and disclose Personally Identifiable Information (as defined below). This Privacy Policy (“Policy“) describes our practices in connection with Personally Identifiable Information we collect through this website (“Site“). Except as otherwise stated in the CCPA supplement to this Policy (“CCPA Supplement“), this Policy does not address our practices concerning information that we collect through any website, or by any other means, other than through the Site; nor does this Policy govern the collection, use or disclosure of information by any of our affiliates (collectively, “Affiliated Entities“) or by third parties.

By using the Site, you acknowledge the terms and conditions of this Policy. If you do not agree to the terms and conditions of this Policy, please do not use the Site. We reserve the right to change this Policy without prior notice. You can determine when this Policy was last revised by referring to the “LAST UPDATED” date at the top of this page. Subject to applicable law, any changes to our Policy will become effective upon our posting of the revised Policy on the Site. Use of the Site following such changes constitutes your acknowledgment of the revised Policy then in effect. Use of the Site is also subject to PDF’s Terms of Service, which are available at [/company/trust-center/terms-of-service]

1. WHAT CATEGORIES OF PERSONAL INFORMATION ARE COLLECTED AND WHAT ARE THE PURPOSES FOR WHICH THEY ARE USED?

PDF gathers certain “Personally Identifiable Information” (or “PII“), from you when you interact with the Site. Personally Identifiable Information is information that relates to or identifies you as an individual, as generally understood under applicable law.  You do not have to provide PII to use the Site. However, in order for you to take advantage of particular opportunities provided through the Site (for example, to register for technical support or software maintenance), we may request that you furnish PII. This section also serves as a notice “at-collection” for Site visitors who are California residents and provides information on the categories of PII and the purposes for which they are used. Please refer to the CCPA Supplement [/company/trust-center/ccpa] for further information and CCPA related disclosures.

In particular, PDF collects the following types of PII:

a. Contact Details. We collect contact information related PII from you, such as your name, postal address, telephone number and e-mail address, only when you voluntarily provide it to us. We use this information for the following purposes:

  • To provide information about our products, services and solutions, when you use the “Contact Us” section of the Site, the “Information Request” section or other “Contact Us” links on the Site.
  • To process your application and contact you if you submitted your resume for a job with us using the “Current Openings” section of the Site;
  • To allow you to listen to or view our webcasts and earnings calls using the links in the “Investor Relations” section of the Site.
  • To fulfill your requests, such as to provide you with technical support or software maintenance.
  • From time to time, in our sole discretion, we may use contact details to send you important information regarding the Site, changes to our terms, conditions, and policies and/or other administrative information.
  • For internal business purposes, such as data analysis, audits, developing new products, enhancing our Site, improving our services, identifying usage trends and determining the effectiveness of our promotional campaigns.
  • For marketing purposes, in each case, subject to applicable law.

b. Educational and Work History Information. Information about your educational background, work history, and credentials. We use this information for the following purposes:

  • To process and evaluate your application if you submitted your resume for a job with us using the “Current Openings” section of the Site;

c. Environmental Variables. We and our service providers may collect certain environmental variables, such as your MAC address, computer type (Windows or Macintosh), screen resolution, OS version, Internet browser, and Internet browser version. These environmental variables are collected by most browsers, and can be used to:

  • Optimize your experience on the Site.
  • To fulfill your requests, such as to provide you with technical support or software maintenance.
  • For internal business purposes, such as data analysis, audits, developing new products, enhancing our Site, improving our services, identifying usage trends and determining the effectiveness of our promotional campaigns.

d. Cookies. The Site makes use of cookies. Cookies are small text files downloaded by your Internet browser and stored on the device you use to access the Site (e.g., your desktop computer, tablet or smartphone). Depending on their purpose, cookies log specific user-related information such as your user preferences, authentication information, security parameters, data concerning the device you access the Site with and statistical information regarding your use of the Site. Where necessary during your visit of the Site or when revisiting the Site, your Internet browser transmits the cookies including the contained information back to the servers they were initially downloaded from or created by. The analysis and processing of such information allows us to ensure the functionality of the Site, improve your online experience and optimize the structure and content of the Site.

The cookies we use can be categorized as follows:

Strictly Necessary Cookies

These are cookies that are required for the operation of the Site or of certain parts thereof. They either serve the sole purpose of carrying out network transmissions or are strictly necessary in order for us to provide an online service explicitly requested by you.

Analytical/Performance Cookies

These cookies allow us to carry out web analytics or other forms of audience measuring such as recognizing and counting the number of visitors and seeing how visitors move around the Site. This helps us to improve the way the Site works, for example, by ensuring that users are easily finding what they are looking for.

Functionality Cookies

These cookies are used to recognize you when you return to the Site. This enables us to personalize our content for you, greet you by name and remember your preferences (for example, your choice of language or region). Loss of the information in these cookies may make our services less functional but would not prevent the Site from working.

Targeting/Profiling Cookies

These cookies record your visit to the Site and/or your use of the services, the pages you have visited and the links you have followed. We will use this information to make the Site and the advertising displayed on it more relevant to your interests. We may also share this information with third parties for this purpose.

Demographic Information Cookies

These cookies collect and retain limited demographic information such as date of birth and gender, if such information is provided by the user, which is tied to anonymous identifiers and may be referenced by the system for some tailored advertising.

You may influence the scope and extent to which we use cookies when you visit our Site. For more information on how to do so in the settings of your particular Internet browser, please see the following information:

Internet Explorer:

However, please be aware that this might render certain functions of our Site inoperable or more difficult to use. Depending on the Internet browser you use, you might also be able to specifically reject third-party cookies. In this context, please note, however, that third parties might still have access to your PII to the extent that such information is logged by first-party cookies.

e. Pixel Tags. We and our service providers may also use so-called “pixel tags,” “web beacons,” “clear GIFs” or similar means (collectively, “Pixel Tags“) in connection with some Site pages and HTML-formatted e-mail messages to, among other things, track the actions of Site users and e-mail recipients, to determine the success of marketing campaigns and to compile aggregate statistics about Site usage and response rates.

f. IP Addresses. Your IP Address is a number that is automatically assigned to the computer that you are using by your Internet Service Provider (ISP). This number is identified and logged automatically in our server log files whenever users visit the Site, along with the time(s) of such visit(s) and the page(s) that were visited. Collecting IP Addresses is standard practice on the Internet and is done automatically by many websites. We use IP addresses for purposes such as:

  • Calculating Site usage levels, helping diagnose server problems, and administering the Site.
  • For internal business purposes, such as data analysis, audits, developing new products, enhancing our Site, improving our services, identifying usage trends and determining the effectiveness of our promotional campaigns.

g. Information That You Voluntarily Provide. PDF may also collects other PII (e.g., your interests, your geographic location, etc.) when you voluntarily provide such information to us. You will know what PII is collected in this scenario as you will provide it to us. We will generally use PII in this scenario to:

  • Respond to your request or provide further information to you about our products and services.
  • For internal business purposes, such as data analysis, audits, developing new products, enhancing our Site, improving our services, identifying usage trends and determining the effectiveness of our promotional campaigns.

h. Non-Personally Identifiable Information (“Non-PII”). Because Non-PII does not personally identify you, we may use such information for any purpose. In addition, we reserve the right to share such Non PII, which does not personally identify you, with Affiliated Entities and other third parties, for any purpose. Additionally, we may aggregate PII in a manner such that the end-product does not personally identify you or any other user of the Site, for example, by using PII to calculate the percentage of our users who have a particular telephone area code.

2. HOW IS PERSONALLY IDENTIFIABLE INFORMATION DISCLOSED?

Please refer to the jurisdiction specific sections of this Policy for further information on disclosures of PII. [/company/trust-center/gdpr ]

3. OTHER IMPORTANT NOTICES REGARDING OUR PRIVACY PRACTICES.

a. Third Party Sites. The Site may contain links to third party websites. These linked sites (including without limitation the websites of Affiliated Entities) are not under PDF’s control and we are not responsible for the privacy practices or the contents of any such linked site, or any link contained in any linked site. We provide such links only as a convenience, and the inclusion of a link on the Site does not imply endorsement of the linked site by PDF or any Affiliated Entities. If you provide any PII through any such third party website, your transaction will occur on such third party’s website (not the Site) and the PII you provide will be collected by, and controlled by the privacy Policy of, that third party. We recommend that you familiarize yourself with the privacy policies and practices of any such third parties. PLEASE NOTE THAT THIS POLICY DOES NOT ADDRESS THE PRIVACY OR INFORMATION PRACTICES OF ANY THIRD PARTIES, INCLUDING, WITHOUT LIMITATION, THE AFFILIATED ENTITIES.

b. Security. We use reasonable organizational, technical and administrative measures to protect PII under our control. Security measures and tools, such as firewalls, are in place to help protect against the loss, misuse and alteration of the information under our control. Unfortunately, no data transmission over the Internet or data storage system can be guaranteed to be 100% secure. Please do not send us sensitive information through email. If you have reason to believe that your interaction with us is no longer secure (for example, if you feel that the security of any account you might have with us has been compromised), you must immediately notify us of the problem by contacting us in accordance with Section 4.e (“Contacting Us,”) below (note that if you choose to notify us via physical mail, this will delay the time it takes for us to respond to the problem).

c. Note Regarding the Use of the Site by Children: The Site is not directed to individuals under the age of thirteen (13), and we request that such individuals do not provide PII through the Site.

d. Jurisdictional Issues. PDF does not represent or warrant that the Site, or any part thereof, is appropriate or available for use in any particular jurisdiction. Those who choose to access the Site do so on their own initiative and at their own risk, and are responsible for complying with all local laws, rules and regulations. We may limit the Site’s availability, in whole or in part, to any person, geographic area or jurisdiction we choose, at any time and in our sole discretion. By using the Site and submitting any PII, subject to applicable law, your PII may be transferred to other countries, including the US, which may provide a different level of data security than in your country of residence.

e. Contacting Us. Under applicable law, you may have certain rights relating to access, correction, or deletion of your PII. Please refer to the GDPR supplement [/company/trust-center/gdpr] and CCPA Supplement [/company/trust-center/ccpa] to this Policy for jurisdiction-specific information relating to such rights.
